The pause will allow a farmworker association lawsuit to be resolved first.
This week, District Judge Roy Altman temporarily blocked a Florida law that imposes criminal penalties against residents who knowingly transport illegal immigrants into the state. Judge Altman ruled that the law would be blocked until a lawsuit filed by the Farmworker Association of Florida is resolved. The farmworker suit alleges that the law’s enactment negatively impacted their businesses.
Plaintiffs claim that the law puts people, including U.S. citizens, at risk of arrest or prosecution for driving someone to an appointment or even going on vacation.
Judge Altman said the law may be invalid since it “extends beyond the state’s authority to make arrests for violations of federal immigration law and, in so doing, intrudes into territory that’s preempted” by federal law.
